Ref: Paul Laurenson’s claim to Disability Living Allowance (DLA)

 

 

Thank you for your letter received in this office on 27th February,

regarding Mr Laurenson’s claim to DLA.

 

Regrettably Mr Laureson was a victim of the Bali Bombing, however we are unable to pay any benefit until he satisfies the conditions relating to residence and presence in Great Britain.

 

If I can explain that in order for a person to be entitled to DLA they must be ordinarily resident in Great Britain, must not be subject to Immigration control, must be present in Great Britain and must have been present in Great Britain for not less than 26 weeks out of 52 weeks.

 

The Social Security (Disability Living Allowance) Regulations 1991, Reg. 2(1) refers:

 

Subject to the following provisions of this regulation, the prescribed conditions for the purpose of the Act as to residence and presence in Great Britain in relation to any person on any day shall be that-

(a) on that day-

 

(ii) he is present in Great Britain: and

(iii) he has been present in Great Britain for a period of, or for periods amounting in the aggregate to, not less than 26 weeks in the 52 weeks immediately preceding that day;

 

I appreciate Mr Laurenson’s disagreement with the rules, however we must adhere to them. He will be able to claim DLA from 30.05.03, when the residence and presence conditions are satisfied.
